Notice by Shanghai Municipal Commission of Commerce on the issuance of Implementation Measures of Optimization on Automatic Import License Application and Clearance of Electromechanical Products and Improvement of Cross-border Trade Business Environment in Shanghai

Commerce Departments and Related Units of District Governments:

The commission formulates the Implementation Measures of Optimization on Automatic Import License Application and Clearance of Electromechanical Products and Improvement of Cross-border Trade Business Environment in Shanghai in order to deeply implement the arrangements for the improvement of business environment reform by the Party Central Committee and the State Council, the work arrangements by CPC Shanghai Municipal Committees and Shanghai Municipal People’s Government; and to further optimize the automatic import license application and clearance of electromechanical products.

Now the Implementation Measures of Optimization on Automatic Import License Application and Clearance of Electromechanical Products and Improvement of Cross-border Trade Business Environment in Shanghai is issued. Please refer to the attached text for implementation.

Implementation Measures of Optimization on Automatic Import License Application and Clearance of Electromechanical Products and Improvement of Cross-border Trade Business Environment in Shanghai

The implementation measures are formulated in order to further optimize the automatic import license application and clearance of electromechanical products, and improve the cross-border trade business environment, in accordance with the Notice of ‘the Plan for the Optimization of Business Environment and the Construction of Open Economic System’ issued by the CPC Shanghai Municipal Committee and Shanghai Municipal People’s Government (No. [2017]38, issued by the Shanghai Municipal Committee). It is also aimed for the implementation of the important instructions on enhancement of business environment reform by General Secretary Xi Jinping and decisions by the CPC Central Committee and the State Council.

Ⅰ Guiding Principles

With the aim of developing an openness-oriented economic system and implementing policies for trade liberalization and facilitation, Shanghai municipality will target the highest international standards to optimize the licensing and clearance for the automatic import of electromechanical products and reduce cost for businesses.  The policy is focused on key links of the administrative procedures. It also addresses the weaknesses as well as enhances the strength of the current system, offering targeted and tailored services for businesses to optimize their experience. The system was further improved with intensified concurrent and ex-post regulation, development of enterprise credit system, wider coverage of paperless clearance and introduction of self-discipline by the enterprises.

Ⅱ Work objectives

The objectives include adjustment of government’s perspective on administrative measures, transformation of government functions as well as optimization of governance.  The procedures of application, review, and clearance for automatic import licenses of electromechanical products will be restructured with processing time by Shanghai Municipal Commission of Commerce reduced to within 8 hours, making application for automatic import licenses of electromechanical products faster and more convenient; the issuance more open and transparent; and the clearance smoother and more efficient.

Ⅲ Main measures

 (Ⅰ) Delegating power to Shanghai Commerce Administrative Affairs Center

1. All applications shall be submitted to Shanghai Commerce Administrative Affairs Center. The online and offline applications of enterprises are received and handled by the Shanghai Commerce Administrative Affairs Center.

2. The licensing process that includes printing and stamping is delegated to Shanghai Commerce Administrative Affairs Center.

 (Ⅱ) Extending the scope of paperless clearance

3. Paperless clearance will be promoted. Cooperation with Customs will be further strengthened to ensure paperless clearance for all the licenses that fall under the “one approval one license” mechanism. For other types of licenses, reforms are underway for to gradually extend the scope of paperless clearance.

4. Claim of paper license is optional for the applicant. The service of license printing under the “one approval one license” mechanism will still be available for applicants.

5. The reform of E-licensing will be carried out in a gradual manner. E-licensing for automatic import of electromechanical products shall, following the instructions by the Ministry of Commerce of China, be gradually realized, exempting applicants from being physically present for the submission.

 (Ⅲ)Strengthening concurrent and ex-post supervision

6. Corporate credit rating and management system will be established. Applicant companies will be evaluated and classified annually based on their respective credit soundness.

7. The list of enterprise with operational anomalies will be established. There will be a blacklist for companies that violate the application and utilization rules. Applications by companies on the blacklist are subject to stringent evaluation under relevant rules of the Ministry of Commerce.

Ⅳ Work requirements

8. Logistic support for implementation will be enhanced. Shanghai Municipal Commission of Commerce and Shanghai Municipal Commercial Administrative Affair Center will further improve public services provided for the enterprises, with sufficient staff and resources deployed for window service to ensure efficient licensing.

9. Promotion and policy interpretation will be improved. Comprehensive interpretation of new measures for the licensing work will be carried out. Information will be channeled to companies through seminars, training sessions and online release.  

Ⅴ Supplementary provision

10. The implementation measures will take effect from the date of issuance and will be valid for 3 years.
